Terms and Conditions of Service

Welcome to Let’s Walk Chile Tour, a trademark of Servicio de Turismo Miguel Núñez Vega E.I.R.L., RUT 78.417.635-5, with its registered office at Esmeralda 973, Office 502, Valparaíso, Chile.

By booking any of our tours, activities, or tourist services, the customer acknowledges that they have read, understood, and accepted these Terms and Conditions.

1. Purpose

These Terms and Conditions govern the booking and provision of the tourism services offered by Let’s Walk Chile Tour through its website, email, social media, booking platforms, or any other authorized means.

2. Services

Let’s Walk Chile Tour offers tourist experiences, guided tours, excursions, transfers, and tourism-related activities within Chile.

Each service includes only what is expressly stated in its description. Any service not listed as included shall be deemed excluded.

3. Reservations

A reservation will be considered confirmed only when:

• The customer has completed the required reservation form or customer form.
• The customer has completed the sign-up process.
• The corresponding payment or the agreed-upon deposit has been received.
• Let’s Walk Chile Tour has sent a confirmation via email or another agreed-upon method.

The company may reject a reservation when there are justifiable grounds for doing so, promptly notifying the customer and refunding any amounts paid when applicable, in accordance with the applicable refund policies.

4. Prices

All published prices are listed in the currency specified for each service.

The prices include only the items specifically listed in the tour description.

Prices are subject to change without prior notice for new reservations; this will not affect reservations that have already been confirmed.

5. Payment Methods

We accept the payment methods listed on our website.

The reservation may require full payment or a deposit, depending on the service booked.

6. Changes requested by the client

Requests to change the date are subject to availability.

If there are additional costs resulting from changes requested by the customer (such as tickets, transportation, third-party services, or other expenses), these costs must be borne by the customer.

7. Cancellations and Refunds

Unless the specific service specifies different terms:

• Cancellations made more than 48 hours in advance: 100% refund of the amount paid.
• Cancellations made between 24 and 48 hours before the tour begins: an administrative fee may apply.
• Cancellations made between 24 and 48 hours before the tour begins: an administrative fee may apply.

When external providers (such as wineries, museums, restaurants, boats, parks, or others) have different policies, those conditions will take precedence and will be communicated before the reservation is confirmed.

8. Cancellations by the company

Let’s Walk Chile Tour may cancel, suspend, or modify a service when circumstances beyond its control arise, including, but not limited to:

• adverse weather conditions;
• natural disasters;
• fires;
• accidents;
• roadblocks;
• protests;
• instructions from the competent authorities;
• security issues;
• illness or unavailability of the guide;
• breaches by external suppliers; and
• any other unforeseeable event or force majeure.

In such cases, the company may offer, as appropriate:

• rescheduling of the service;
• replacement with a service of similar characteristics; or
• a full or partial refund of the amount paid, as applicable and in accordance with the applicable refund policies.

9. Punctuality

The customer must arrive at the meeting place at least ten (10) minutes before the scheduled time.

Delays or failure to show up may result in the loss of the service, without the right to a refund, when this affects the normal course of the tour.

10. Participant's Obligations

The customer agrees to:

• Follow the instructions given by the guide or Let’s Walk Chile Tour staff;
• behave respectfully toward other participants, collaborators, and local communities;
• to protect our natural, cultural, and historical heritage;
• comply with all safety rules communicated before and during the activity;
• Please notify us in advance of any medical conditions, allergies, disabilities, or physical limitations that may affect your participation.

11. Alcohol and Drug Use

Participants will not be allowed to take part in activities while under the influence of alcohol, drugs, or any substance that could compromise the safety of the participant or the group.

The company may deny access or remove from the activity anyone who fails to comply with this provision, without the right to a refund.

12. Inherent Risks

The customer acknowledges that tourist activities may involve risks associated with travel, transportation, weather conditions, uneven terrain, and outdoor activities.

Let’s Walk Chile Tour will take all reasonable safety measures in accordance with the nature of the service; however, the customer accepts the normal risks inherent in this type of activity.

13. Limitation of Liability

Let’s Walk Chile Tour will be liable only in the cases provided for by Chilean law.

The company will not be liable for:

• loss, theft, or damage to personal belongings;
• delays caused by third parties;
• road closures;
• weather conditions;
• decisions by authorities;
• breaches by external suppliers;
• circumstances constituting unforeseeable events or force majeure.

Nothing in these Terms and Conditions shall limit the inalienable rights granted to consumers under Chilean law.

14. Personal Belongings

Each participant is responsible for taking care of and safeguarding their personal belongings throughout the activity.

Let’s Walk Chile Tour will not be liable for any loss, misplacement, or damage to personal belongings, except where otherwise required by law.

15. Fotografía e imagen

Durante el desarrollo de las actividades podrán capturarse fotografías o videos con fines promocionales, publicitarios o de difusión de los servicios de Let’s Walk Chile Tour.

Si el cliente no desea aparecer en dicho material, deberá comunicarlo por escrito antes del inicio de la actividad.

16. Menores de edad

Los menores de dieciocho (18) años deberán participar acompañados por su padre, madre, tutor legal o un adulto responsable debidamente autorizado, salvo que la naturaleza del servicio establezca condiciones distintas.

17. Protección de datos personales

Los datos personales proporcionados por los clientes serán tratados conforme a la Política de Privacidad de Let’s Walk Chile Tour y a la legislación chilena vigente.

La información será utilizada únicamente para gestionar reservas, prestar los servicios contratados, cumplir obligaciones legales y mantener comunicación relacionada con la prestación del servicio.

18. Propiedad intelectual

Todo el contenido del sitio web, incluyendo textos, fotografías, videos, logotipos, itinerarios, diseños, gráficos y demás material publicado, es propiedad de Let’s Walk Chile Tour o se utiliza con las autorizaciones correspondientes.

Queda prohibida su reproducción, distribución o utilización total o parcial sin autorización previa y por escrito del titular.

19. Legislación aplicable

Los presentes Términos y Condiciones se regirán e interpretarán conforme a las leyes de la República de Chile.

Cualquier controversia derivada de la contratación de los servicios será resuelta conforme a la legislación chilena vigente, sin perjuicio de los derechos que la Ley sobre Protección de los Derechos de los Consumidores reconoce a los clientes.
