In Chile, the undersigned (the “Participant”), for the purpose of participating in the contracted tourist activity (the “Event”), organized by Servicio de Turismo Miguel Núñez Vega E.I.R.L., RUT 78.417.635-5 (the “Organizer”), and which will take place within the territory of the Republic of Chile, hereby freely and voluntarily declares, with full knowledge of his or her rights, the following: (i) That he or she is in adequate physical and health condition to participate in the activity, and does not suffer from any illness, injury, or other condition that would prevent or limit his or her safe participation. (ii) That they are aware of the nature of the activities to be carried out during the Event and are participating in them entirely voluntarily, understanding that some may involve physical exertion, movement over uneven terrain, or other risks inherent in outdoor tourism activities. (iii) That, in light of the foregoing, the Participant releases the Organizer, its representatives, collaborators, guides, drivers, suppliers, and any other persons involved in the organization of the Event from all liability for damages, losses, injuries, accidents, or harm that may occur as a result of the Participant’s participation, except in cases of willful misconduct or gross negligence on the part of the Organizer, in accordance with current Chilean law. Consequently, the Participant waives the right to bring civil or other actions that may arise from risks inherent in the activity and voluntarily assumed by the Participant, without prejudice to the inalienable rights established by law. (iv) You acknowledge that some of the activities included in the Event involve inherent risks, such as falls, injuries, bodily harm, property damage, or other incidents typical of this type of experience, and you voluntarily assume such risks. (v) That the Participant authorizes the Organizer to use photographs, videos, or any other audiovisual recordings obtained during the Event—in which the Participant’s image may appear—for purposes of dissemination, promotion, advertising, social media, corporate materials, and the Organizer’s website, without this giving rise to any right to financial compensation. (vi) That, if any provision of this statement is declared null and void or unenforceable by a competent authority, the remaining clauses shall remain fully valid and in effect. (vii) Who declares that they have read, understood, and accepted in full the terms and conditions for participation in the Event. For its part, Servicio de Turismo Miguel Núñez Vega E.I.R.L., RUT 78.417.635-5, accepts the statements made by the Participant and hereby confirms that both parties have accepted this agreement. *
